If the English and Dutch texts differ, the Dutch text applies.
1. Who I am
Emigratieplan and ResidencyPlanner are trade names of STS Strategy, a sole proprietorship based in the Netherlands.
- Place of business: Waddinxveen
- Phone: +31 (0)6 415 115 65
- Chamber of Commerce (KvK) number: 99794845
- VAT number: NL005411015B79
- Email: kevin@emigratieplan.nl
In these terms I call myself "Provider" or "I". I call you "you".
2. What this document covers
These terms apply to the use of the online tool Emigratieplan and the international version ResidencyPlanner. By buying or using the Tool, you agree to these terms.
3. Definitions
- Assumptions: the model-based starting points the Tool uses for its calculations, such as returns, inflation, tax rates and exchange rates. Part of them is visible and adjustable in the Tool. Another part sits in the calculation logic and is not directly visible.
- Provider: STS Strategy, trade names Emigratieplan and ResidencyPlanner.
- Account: your personal access to the Tool, linked to your email address and secured with a magic link.
- Input: all data you enter in the Tool.
- Licence: the right to use the Version you buy under these terms, as described in article 6.
- Output: all calculations, scenarios and reports that the Tool generates from your Input.
- Reference Year: the tax year whose rates and rules are built into a Version. The Reference Year is shown in the Tool and on the sales page.
- Tool: the online calculation tool Emigratieplan or ResidencyPlanner, including all its functions and related reports.
- Version: a release of the Tool with its own Reference Year. Each Version is a separate one-off purchase.
4. What the Tool is, and what it is not
The Tool is a calculation model. You enter your situation. Based on Assumptions, the Tool calculates how different emigration scenarios look financially over a period of up to 50 years.
The Tool does not give:
- financial advice within the meaning of the Dutch Financial Supervision Act (Wft)
- tax advice
- legal advice
- investment advice
- a recommendation to choose a particular country, product, service provider or structure
The Output is a comparison of scenarios based on your Input and the Assumptions you chose. I calculate possibilities. I do not tell you what to do.
You remain responsible for your own decisions. To carry out an emigration or a tax structure, consult an adviser who knows your situation fully. Do not take an irreversible decision, such as selling your house or cashing in your pension, before a qualified adviser has seen your figures.
Partners. On the website and in the Tool I name companies you can turn to for help with your emigration in a particular country. If you become a client of such a partner through me, I receive a fee for that. That changes nothing in the calculation. The Tool calculates every country in the same way, and my naming a partner is not a recommendation to choose that country or that company.
5. How you buy a Licence
You buy a Licence through my checkout (Stripe). Your Account is linked to a unique email address. After payment you receive a confirmation by email and access to your Account through a magic link.
Stripe processes the payment as payment processor. The Provider is the seller of the Licence, sends the invoice and pays the VAT itself.
There are three packages. They differ in the number of target countries you can compare and in what you receive besides the Tool. The current contents and price of each package are on the website at the time of purchase.
You can buy the Tool anywhere in the European Union.
6. What you buy and how long you keep access
You make a one-off purchase. You buy the Version that is on sale at that moment, with the Reference Year shown with it. There is no subscription, and nothing is renewed or charged again automatically.
What you get:
- Access to the Version you bought.
- Availability for at least 3 years from your purchase date, and after that for as long as the Provider offers the Tool.
- Repair of security problems and errors during that period of at least 3 years. That is the period in which I provide maintenance.
What you do not get automatically:
- New features.
- New countries.
- Updated tax rates, legislation or calculation rules. Your Version keeps calculating with the Reference Year you bought.
- Access to a later Version.
New Versions. If I release a new Version, it is a separate one-off purchase. If you already have a Version, you get a discounted price. You do not have to cancel anything if you do not want the new Version. Your existing access simply stays in place.
This differs from what you may be used to with software. You are not buying a continuously updated service. You are buying one Version with a fixed Reference Year. Before you pay, you confirm that you understand this, separately from your agreement to these terms.
Ending the Tool. If I decide to stop the Tool, I announce that at least 6 months in advance. You then get the chance to export your Input and scenarios locally. After the 3-year period, every obligation to continue lapses.
7. What you need to use the Tool
The Tool works in your browser. You need a current version of Chrome, Safari, Firefox or Edge, an internet connection, and an email address where you can receive the login link. You need no password and no installation.
For every calculation your Input goes to my calculation server in the European Union. It sends the result back and does not keep your Input. Your Input and your scenarios are not stored on my servers, and I cannot see them. I do record, for every calculation, that you accepted the disclaimer, together with a digital fingerprint of your Input. Your Input cannot be recovered from that fingerprint. If you close your browser or clear your browser data, they are gone. If you want to keep them or share them with your adviser, you export them yourself to a JSON file on your own device. You can read that file back in later.
The Tool works on its own and needs no link with other software. No digital protection limits your use, except access to your own Account and the number of target countries that comes with your package.
Besides these terms, the law applies. It requires that what I deliver conforms to what you may expect under the agreement. If the Tool falls short of that, you have the rights the law gives you, even if these terms say nothing about it.
8. Cooling-off period, cancellation and satisfaction guarantee
One period: 30 days after your purchase. Up to 30 days after your purchase you can cancel the agreement without giving a reason. The 14-day cooling-off period that the law gives you falls within it. That statutory cooling-off period starts on the day after your purchase.
How to do it. Use the cancellation function on my website (in Dutch). You enter your name, your order number and your email address and click cancel. You get a confirmation by email straight away, with the date and time. You can also use the model withdrawal form (PDF, in Dutch) or simply email me at kevin@emigratieplan.nl. Any clear message is enough.
You pay nothing for the use in that period. The Tool opens straight after your purchase. If you cancel within those 30 days, you get the full purchase price back, even if you have already used the Tool. I do not charge a fee in proportion to your use. Your money is usually back within five working days, and at the latest within 14 days after your message, through the same payment method. After that your access to the Tool ends.
Satisfaction guarantee. Those 30 days are my satisfaction guarantee. They go further than the law, but they do not come on top of your statutory right of withdrawal: the 14-day cooling-off period falls within them. This guarantee leaves your statutory rights unaffected.
9. What you may do with the Tool and the Output
You may:
- Use the Tool for your own personal situation and that of your family.
- Download and keep the Output, and share it with your own advisers, partner and immediate family.
- Export your Input and scenarios locally to a JSON file.
You may not:
- Reuse the Tool or the Output commercially.
- Distribute the Output publicly.
- Reverse-engineer or copy the calculation logic.
- Use the Tool to build a competing product.
- Share your access with people outside your household.
10. Intellectual property
All rights in the Tool, the software, the calculation logic, the Assumptions, the texts, the design and the brands Emigratieplan and ResidencyPlanner lie with me or with my licensors.
You keep the rights in your own Input. On the Output you get a right of use as described in article 9.
11. Availability and maintenance
I aim for good availability of the Tool, but I give no uptime guarantee. I may:
- Carry out planned maintenance.
- Fix bugs and roll out security updates.
- Improve or adjust the Tool.
Changes that go beyond maintenance. I only change your Version if there is a good reason. There is one in these cases: a security problem, a changed law or rule, a technical necessity such as a supplier stopping a service, or an error in the calculation logic that has to be fixed.
If such a change puts you at a material disadvantage, I announce it by email at least 30 days in advance. You can then cancel the agreement free of charge within 30 days after the announcement or after the change. You get your purchase price back in proportion to the time left in the 3-year period. You can also choose to keep using your Version unchanged, if that is technically possible.
12. Liability
The Tool is a calculation model. Results depend on your Input, the Assumptions and factors I cannot predict, such as changes in the law, the interpretation of tax treaties, exchange rates and your personal circumstances.
You use the Tool at your own responsibility. For decisions with financial, tax or legal consequences, consult a qualified adviser.
Limit of liability. My liability towards you is limited to 25,000 euros per event and 50,000 euros per calendar year. A series of related events, such as one error in the calculation logic that affects several calculations, counts as one event.
Why I limit it. The Tool is a calculation model that processes your own Input. With every calculation you confirm that the Output is not tax advice. I have tried to insure this risk. No insurer covers it. And the price of a Licence is out of proportion to the amounts at stake in a decision about emigration.
What I do not compensate:
- Damage caused by your own Input or by your changes to the Assumptions, to the extent the damage can be attributed to them.
- Damage caused by changes in legislation or in the interpretation of treaties after your purchase.
- Lost profit and other consequential damage in the course of a profession or business.
What I do not limit:
- Liability for intent or deliberate recklessness of the Provider.
- Liability for death or personal injury.
- Liability under the statutory rules on product liability.
- Rights you have under mandatory consumer law, including your rights if the Tool does not conform to the agreement.
13. Complaints
Send a complaint to kevin@emigratieplan.nl. I respond within 10 working days. If you and I cannot resolve it together, you can bring the dispute before the court that has jurisdiction under mandatory consumer law. A complaint to me costs you none of your statutory rights.
14. Personal data
How I handle personal data is described in my Privacy statement.
15. Changes to these terms
I may change these terms. For your purchase, the terms that applied when you bought remain in force, unless a change is needed because of law or regulation.
For material changes I inform you by email at least 30 days in advance.
16. Applicable law and competent court
Dutch law applies to these terms. If you live in another country of the European Union, you keep the protection of the mandatory consumer law of the country where you live. Disputes are brought before the court that has jurisdiction under mandatory consumer law.
